			<content:encoded><![CDATA[<p>All of the staff here at Hunters Against PETA couldn&#8217;t help but laugh as we read through PETA&#8217;s ridiculous top ten reasons not to eat salmon. It is true that PETA will try whatever tactic they can to turn people into vegans so the rest of the world will be eating nothing but rabbit food. Sorry PETA but this one didn&#8217;t work. As a matter of fact we&#8217;re all going to go buy a nice big salmon fillet and eat it for dinner. Actually reading their article made all of us here want to go eat salmon for lunch. Here&#8217;s the most ridiculous reason we found in their list.</p>

Fish learn from each other, have long-term memories, and can recognize one another. They gather information by eavesdropping, and some species even use tools, which, until recently, was thought to be a uniquely human trait. Like the dogs and cats with whom we share our homes, they also like to play, investigate new things, and hang out with friends.&#8221; </p>

			<content:encoded><![CDATA[<p>Big Game Forever Supports new legislation aimed at curbing excessive ESA lawsuits</p>
<p>Folks,</p>
<p>A very important piece of legislation was filed today in the United States Congress, the Government Litigation Savings Act (GLSA).  The bill is aimed to stop abusive litigation practices and diversion of tens of millions of taxpayer dollars to anti-sportsmen groups.  The bill does not stop private groups from suing to enforce federal law. Instead, the bill limits the number and amount of reimbursements that groups can receive from taxpayers for suing the government.  As many of you are aware, the Equal Access to Justice Act (EAJA) requires taxpayers to reimburse the litigation costs to plaintiffs in environmental lawsuits.  It has become so easy to satisfy the EAJA requirements, that reimbursement are almost automatic in most of these cases.</p>
<p>Big Game Forever supports the Government Litigation Savings Act as yet another example of common sense pro-sportsmen legislation.  Some preliminary research indicates that many of these cases are &#8220;won&#8221; on technicalities that have little to do with recovery of endangered wildlife species.  As a result, it has become easy for anti-sportsmen groups to force an anti-sportsmen agenda at the government&#8217;s expense.  Just as important, this bill could save tens of millions in unnecessary government spending.  The press release below from Senator Barrasso and Senator Hatch explains the bill in greater detail.  </p>
<p>Big Game Forever has been asked to support the legislation by a number of members of Congress.  We feel this bill is a step in the right direction in restoring some common sense in wildlife management.  If you are a constituent of Rep. <p>Barrasso, Hatch Introduce Bill to Curb Environmental Extremists’ Excessive Lawsuits against Federal Government, Taxpayers  </p>
<p>WASHINGTON – Sens. John Barrasso (R-Wyo.), Orrin Hatch (R-Utah) and other members of the Senate Western Caucus today introduced a bill aimed at clamping down on the excessive lawsuits being filed by environmental extremists against the federal government that are costing U.S. taxpayers millions of dollars.<br />
The Government Litigation Savings Act (GLSA) would reform the Equal Access to Justice Act (EAJA), which environmental extremist groups are systematically abusing to halt the work of land management and other federal agencies to use taxpayer money to fund their nonstop litigation and further their own narrow political agenda.</p>
<p>“These environmental groups have sued the federal government more than 1,200 times and collected more than $35 million from taxpayers. That has got to stop,” Hatch said. “Our nation must not allow and cannot afford to let extremists hijack our laws and hold the American people hostage to their radical views. This legislation will help put a stop to the abuses of these deep-pocketed environmental groups, bring greater reporting and accountability to the process and lessen taxpayers’ burden to pay for the attorney fees incurred by these lawsuits.”</p>
<p>As adopted by Congress in 1980, the EAJA was aimed at removing a barrier to justice by helping individuals, small businesses and nonprofit organizations recoup the money and other resources they spent in suing the federal government. For the past 15 years, Hatch noted, Congress and federal agencies have stopped tracking and reporting payments paid through the law, meaning there has been almost no accountability and oversight. As a result, the law has been subverted by a cadre of environmental groups to create a cottage industry of taxpayer-funded litigation.<br />
If passed, the GLSA would change that by:</p>
<p>Requiring EAJA filers must show a “direct and personal monetary interest” in the action; </p>
<p>Removing the $7 million net worth eligibility exemptions granted to nonprofits organizations and Agriculture Cooperatives; </p>
<p>Establishing a cap of $175 per hour for attorney’s fees, pegged to inflation; all additional multipliers are removed;</p>
<p>Requiring an agency to disallow EAJA reimbursements if the claimant unreasonably protracted the proceedings or acted in bad faith;</p>
<p>Capping total EAJA reimbursements to $200,000 for any single action, and allowing no more than 3 EAJA awards in a calendar year;</p>
<p>Establishing reporting requirements government-wide, and consolidating reporting into the Administrative Conference of the United States (ACUS); the report must include an explanation from the agency explaining why its position was not substantially justified;</p>
<p>Establishing an online, searchable database for funds paid out of EAJA and requiring that funds paid from EAJA in sealed settlement agreements must be included in the online report;</p>
<p>Requiring judges to disallow EAJA payments if the claimant unreasonably protracted the final resolution of the matter in controversy, or acted or in bad faith;</p>
<p>Requiring that as part of the annual report of payments under EAJA, the Attorney General must also make available to information about payments made from the Judgment Fund; </p>
<p>Ad Requiring the GAO to conduct an audit of EAJA payments over the past 15 years.</p>
<p>In addition to Hatch, co-sponsors include Sens. John Thune (R-S.D.), James Risch (R-Idaho), Mike Crapo (R-Idaho) and Dean Heller (R-Nev.). Members of the House Western Caucus have introduced a companion bill in the House.</p>

However, they are now supporting wildlife, donating a large quantity of money every year.There are many people I have convinced into thinking that the hunter&#8217;s purpose is to destroy our environment and our home, earth. You Hunters think that the organizations defending wildlife are useless, but they are not. Organizations such as PETA, The Humane Society of the U.S., and Defenders of Wildlife those mentioned in your website, are the voices of all those innocent animals you hunters kill day by day. Lets face reality, PETA has and will always have more members that you will ever have. Look, I admire the will you hunters have in succeding, but I am sorry to say that it will never be good enough. I am truly disapointed about your hypocrisy towards the &#8220;love&#8221; hunters have towards nature. My objective is to teach hunters what love really means and what the meaning of life is.</p>

<p>Folks,</p>
<p>Big Game Forever has been getting a number of requests for updates on what has been happening in Congress with wolf delisting.  H.R. 509 and S.249 continue to gain more ground.  Wolf language has also been included in versions of the Continuing Resolution (CR).  We continue to work diligently on H.R. 509 and S.249 while also monitoring the language on the CR.</p>
<p>An article appeared in a Capitol Hill newspaper Roll Call entitled, &#8220;Wolf Fight Draws Howls in Montana.&#8221; Roll Call is a newspaper sent to every Senator, Representative and staffer on capitol hill.  In other words, wolves are a hot topic in the halls of Congress.  While the article is focused on Montana, it shows the nature of the debate on wolf delisting legislation before Congress.  </p>
<p>Quote: “Everybody agrees that wolves should be hunted now. The question is who gets to decide — [President] Barack Obama or [Montana Gov.] Brian Schweitzer,” said Iverson, Rehberg’s consultant. “It’s a livelihood issue out here for folks. They make their living off the land, and wolves are literally destroying their livelihood.”</p>

<p>It doesn’t matter whether any voters live in Kootenai or Lolo — western Montana’s national forests are home to a fierce and breathing debate ­likely to play prominently in the state’s 2012 Senate contest.</p>
<p>The wolves aren’t going away.</p>
<p>As Washington has clashed over how many billions of dollars to cut from the federal budget, some Montanans focused on a provision tucked into the massive spending bills that would have allowed them to begin hunting gray wolves, which have been protected by the federal Endangered Species Act for more than three decades.</p>
<p>While some environmental groups are howling, the consensus among the state’s political elite in both parties supports the immediate hunting of gray wolves, which numbered at least 524 in Montana at the beginning of 2010, according to state data.</p>

<p>&#8220;BILLINGS, Mont. — Defying federal authority over gray wolves, <a href="http://topics.chron.com/topics/Montana">Montana</a> Gov. <a href="http://topics.chron.com/topics/Brian_Schweitzer">Brian Schweitzer</a> on Wednesday encouraged ranchers to kill wolves that prey on their livestock — even in areas where that is not currently allowed — and said the state will start shooting packs that hurt elk herds.</p>
<p>Schweitzer told The Associated Press he no longer would wait for federal officials to resolve the tangle of lawsuits over wolves, which has kept the animals on the endangered species list for a decade since recovery goals were first met.</p>
<p>&#8220;We will take action in Montana on our own,&#8221; he said. &#8220;We&#8217;ve had it with <a href="http://topics.chron.com/topics/Washington,_D.C.">Washington, D.C.</a>, with Congress just yipping about it, with (the Department of) Interior just vacillating about it.&#8221;</p>
<p>State wildlife agents and ranchers already kill wolves regularly across much of the Northern Rockies, where 1,700 of the animals roam parts of five states. Rules against killing wolves have been relaxed significantly by federal officials over the past decade but hunting remains prohibited.</p>
<p>Livestock owners in southern Montana and Idaho have authority to defend their property by shooting wolves that attack their cattle, sheep or other domestic animals. And federal agents regularly kill problem wolves, with more than 1,000 shot over the past decade.</p>
<p>But Schweitzer is moving to expand those killings beyond what the <a href="http://topics.chron.com/topics/United_States_Fish_and_Wildlife_Service">U.S. Fish and Wildlife Service</a> has so far allowed, including to parts of Montana where ranchers are not allowed to shoot the predators.</p>
<p>Fish and Wildlife spokesman Chris Tollefson said the agency was working with Montana and other states in the region to address their concerns over the wolf population.</p>
<p>&#8220;We&#8217;ve been in negotiations with Montana and the other states for some time, and we&#8217;re committed to continuing that and trying to find a solution that works for everybody,&#8221; he said.</p>
<p>In a letter to Interior Secretary <a href="http://topics.chron.com/topics/Ken_Salazar">Ken Salazar</a> provided by Schweitzer&#8217;s office, the Democratic governor said state game wardens will be directed to stop investigating wolf shootings north of Interstate 90, the part of the state with the strictest protections for the animals.</p>
<p>That follows a similar show of defiance from Idaho&#8217;s Republican governor, <a href="http://topics.chron.com/topics/Butch_Otter">C.L. &#8220;Butch&#8221; Otter</a>.</p>
<p>Otter said in the fall that Idaho Fish and Game agents would no longer participate in wolf management efforts, including shooting investigations. The move forced federal officials to step in to enforce restrictions on killing the animals.</p>
<p>Federal enforcement of laws against killing protected wolves also would be expected in Montana.</p>
<p>But critics of federal wolf policies appeared emboldened by the governor&#8217;s Wednesday statements. Robert Fanning, who heads a group that advocates protecting elk herds around <a href="http://topics.chron.com/topics/Yellowstone_National_Park">Yellowstone National Park</a> from wolves, sent out an e-mail urging Montana residents to &#8220;lock and load and saddle up while there is still snow on the ground.&#8221;</p>
<p>In the <a href="http://topics.chron.com/topics/Bitterroot_Valley">Bitterroot Valley</a> south of Missoula, Schweitzer directed Montana Fish, Wildlife and Parks to begin removing wolf packs blamed for driving down elk populations.</p>
<p>The state has a pending petition before the Fish and Wildlife Service to remove a dozen wolves in the Bitterroot. A decision on that petition is pending, according to federal officials.</p>
<p>But Schweitzer indicated Wednesday he was not going to wait, and would leave it to state wildlife agents to decide when to kill the wolves. He was less adamant in the letter to Salazar, which said the Bitterroot packs would be killed &#8220;to the extent allowed by the Endangered Species Act.&#8221;</p>
<p>Department of Interior spokeswoman Kendra Barkoff said the agency agreed there was an &#8220;urgent need&#8221; to turn over wolf management to states that have acceptable management plans for the animals.</p>
<p>&#8220;But the governor&#8217;s letter is not the answer,&#8221; she added.</p>
<p>Federal wildlife officials have tried twice in the last four years to lift endangered protections for wolves and turn over management to the states. Both attempts were reversed in federal court.</p>
<p>A provision in a budget bill pending before Congress would revoke endangered species status for wolves in Montana and Idaho. Other measures introduced by lawmakers would lift federal protections across the lower 48 states.</p>
<p>Despite the bitter public divide on the issue, attacks on livestock by other, unprotected predators such as coyotes far exceed damage from wolves, according to <a href="http://topics.chron.com/topics/United_States_Department_of_Agriculture">U.S. Department of Agriculture</a> statistics. But the lack of state control over wolves because of their endangered status has frustrated both livestock owners and elk hunters, who complain that their hands are tied by federal protections.</p>
<p>&#8220;This is a real-life problem in Montana — and we plan to start solving the problem,&#8221; Schweitzer said.&#8221;</p>

<p>Today a monumental step  forward was made in the wolf delisting effort. Congressman Denny Rehberg  (R) Montana and Congressman Jim Matheson (D) Utah sent the attached <a href="http://biggameforever.us1.list-manage.com/track/click?u=4deed78148257076f8e0eaddd&amp;id=312ba6d27b&amp;e=a0b38813f6" target="_blank">“Dear Colleague Letter” [pdf]</a> asking every Congressman to support the American Big Game and Livestock Protection Act H.R. 509 and S.249.</p>
<p>Currently these bills have 30 house and senate cosponsors from 16 states. The <a href="http://biggameforever.us1.list-manage.com/track/click?u=4deed78148257076f8e0eaddd&amp;id=60322e5f25&amp;e=a0b38813f6" target="_blank">letter</a> strongly states, “We strongly feel that Congressional action is the  only way to protect our rights to responsibly manage wildlife by  avoiding further litigation.” We expect many more cosponsors and “yes”  votes in the coming weeks.</p>

<p>The Senate announced the introduction  of The American Big Game and Livestock Protection Act (S.249). This  bill, follows S. 3919 by returning management of wolf populations to  state wildlife agencies who were so instrumental in recovery of wolf  populations. Returning balance to the ecosystem will not only benefit  America’s Big Game and Livestock resources, but also ensure balanced  levels of wolf populations under state wildlife protections.</p>
<p>The  original cosponsors of this legislation are: Sens. Orrin Hatch (R-Utah),  John Barrasso (R-Wyo.), Mike Crapo (R-Idaho), Michael Enzi (R-Wyo.),  Jon Kyl (R-Ariz.), Mike Lee (R-Utah), John McCain (R-Ariz.) and James  Risch (R-Idaho). Very much like H.R. 509 introduced last week in the  House of Representatives, S.249 bill would prevent further litigation  and pre-empt existing lawsuits related to state wolf populations.</p>
<p>This  legislation is officially endorsed by Rocky Mountain Elk Foundation,  Sportsmen for Fish and Wildlife, Congressional Sportsmen Foundation,  Mule Deer Foundation, Wild Sheep Foundation, National Trappers  Association, Safari Club International, U.S. Sportsman’s Alliance,  National Rifle Association (NRA), American Farm Bureau, American Sheep  Industry Association, National Cattleman’s Beef Association, Public  Lands Council and many other livestock and wildlife conservation  organizations.</p>
